Terms of Service

By accessing or using the Allignx platform, website, or mobile application (collectively, "Services"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, please do not use our Services. These Terms constitute a legally binding agreement between you and Allignx, Inc. ("Allignx," "we," "us," or "our"). We reserve the right to update these Terms at any time; continued use of the Services after changes constitutes your acceptance.

Allignx provides an online marketplace that connects homeowners ("Customers") with independent service professionals ("Providers") for home maintenance and improvement services including, but not limited to, cleaning, plumbing, electrical work, HVAC, and landscaping.

Allignx acts as a technology platform and is not itself a service provider. Independent Providers are not employees, agents, or contractors of Allignx. Allignx does not guarantee the quality, safety, or legality of services offered by Providers and makes no warranties regarding Provider availability.

To use certain features of our Services, you must create an account. You agree to:

• Provide accurate, current, and complete registration information
• Maintain the security of your password and account credentials
• Notify us immediately of any unauthorized account access
• Accept responsibility for all activities under your account
• Not create accounts on behalf of others without authorization
• Be at least 18 years of age to create an account

Allignx reserves the right to suspend or terminate accounts that violate these Terms, contain inaccurate information, or engage in fraudulent activity.

Booking

When you book a service through Allignx, you are entering into a direct service agreement with the Provider. Allignx facilitates the connection and payment but is not a party to the service contract. You are responsible for providing accurate service location details and being present (or designating a representative) at the scheduled time.

Cancellations & Refunds

• Full refund: Cancellations made more than 24 hours before the scheduled appointment.
• 50% refund: Cancellations made between 2–24 hours before the appointment.
• No refund: Cancellations made less than 2 hours before the appointment or no-shows.

Refunds are processed within 5–7 business days to your original payment method. Allignx reserves the right to modify the cancellation policy with reasonable notice.

All payments are processed securely through our third-party payment processor. By providing payment information, you authorize Allignx to charge the applicable fees.

• Service fees are displayed prior to booking confirmation
• Allignx charges a platform fee on each transaction
• Applicable taxes will be added based on your location
• Pricing is in US dollars unless otherwise stated
• Promotional pricing is subject to terms and expiration dates

If payment fails, your booking may be automatically cancelled. You agree to keep your payment information current and accurate.

Allignx verifies Providers through background checks, license verification, and identity confirmation. However, Allignx does not employ Providers and cannot guarantee their performance. You acknowledge that:

• Providers are independent contractors, not Allignx employees
• Allignx is not liable for Provider actions, errors, or omissions
• You should review Provider profiles and ratings before booking
• Any disputes with Providers should first be reported to Allignx support

You agree not to use our Services to:

• Engage in fraudulent, deceptive, or misleading activity
• Harass, abuse, or threaten other users or Providers
• Circumvent Allignx's platform by arranging off-platform transactions
• Post false, defamatory, or misleading reviews
• Violate any applicable laws or regulations
• Attempt to gain unauthorized access to our systems
• Use our Services for any illegal purpose

Violation of these conduct rules may result in immediate account suspension or termination without refund.

All content on the Allignx platform — including text, graphics, logos, images, software, and trademarks — is the property of Allignx, Inc. or its licensors and is protected by intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the Services for personal, non-commercial purposes. You may not reproduce, distribute, modify, create derivative works of, or commercially exploit any part of our Services without prior written consent from Allignx.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. ALLIGNX DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:

• IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE
• ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT
• UNINTERRUPTED OR ERROR-FREE OPERATION OF THE SERVICES
• QUALITY OR SAFETY OF SERVICES PROVIDED BY INDEPENDENT PROVIDERS

Some jurisdictions do not allow disclaimer of implied warranties, so the above may not fully apply to you.

TO THE FULLEST EXTENT PERMITTED BY LAW, ALLIGNX SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, EVEN IF ALLIGNX HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. ALLIGNX'S TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT PAID BY YOU FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM IN THE 3 MONTHS PRECEDING THE CLAIM, OR (B) $100 USD.

These Terms shall be governed by and construed in accordance with the laws of the State of Arizona, United States, without regard to its conflict of law provisions. Any dispute arising under these Terms shall be resolved through binding arbitration in Maricopa County, Arizona, in accordance with the American Arbitration Association's rules, except that either party may seek injunctive relief in a court of competent jurisdiction. You waive any right to a jury trial and to participate in class action proceedings.
